Understanding VAT and Indirect Taxation

Value Added Tax (VAT) is an indirect tax on consumption paid by the final consumer. It is a multi-phase tax applied at all production and distribution stages. As a neutral tax, companies can deduct the VAT paid on their purchases. It applies to goods, services, intra-community acquisitions, and imports.

VAT Rates and Compliance

  • General Rate: 21%
  • Reduced Rate: 10% (hotels, transport, some food)
  • Super Reduced Rate: 4% (bread, books, essential goods)

The VAT import base is calculated as: CIF/CIP value + customs duties + anti-dumping duties + excise duties + import expenses. Note that exports, intra-community deliveries, and international transport are exempt. Special territories include the Canary Islands (IGIC) and Ceuta & Melilla (IPSI).

Excise Duties (II.EE)

Excise Duties (II.EE) are indirect taxes on specific products, typically applied as a single-phase tax. Categories include alcohol, fuel, tobacco, electricity, and vehicles. Their objectives are to generate public revenue, control consumption, and protect health and the environment. Under the suspensive regime, taxes are suspended while goods are stored, transported, or produced.

Anti-Dumping Duties and Trade Regulations

Anti-dumping duties are extra taxes on imports sold at predatory prices to protect domestic industry and prevent unfair competition. These can be provisional (temporary) or definitive (maximum 5 years) and follow a process of initiation, investigation, and final decision.

INTRASTAT Reporting

INTRASTAT is the EU statistical system for trade between member states. It is mandatory for VAT taxpayers with annual trade exceeding €400,000. The Spanish statistical territory includes the Peninsula and Balearic Islands but excludes the Canary Islands, Ceuta, and Melilla. Declarations must be submitted monthly before the 12th day.

VAT vs. Excise Duties

VAT is a general multi-phase tax, whereas II.EE are specific single-phase taxes. Notably, excise duties are included in the VAT taxable base.
