Social Security in Spain
Social security is the protective action, supported by government guarantees, that provides freedom and adequate social benefits for all citizens in situations of need.
Security Levels
- Contributory: Individuals who have previously contributed a minimum amount.
- Non-contributory: Those who have never contributed or have done so inadequately.
Regimes of the Social Security System (Employees)
- General Regime: Employees who are not in any special arrangements, including sales representatives, professionals, artists, and bullfighters.
- Employed
- Special Regimes: Groupings of professional activities that require special attention due to their peculiarities, conditions of time and place, or the nature of their production processes. The main group is formed by the self-employed regime (RETA).
- Self-employed (RETA)
- Students (student insurance)
- Public officials, civilian and military
- Employees of mining, coal, marine, agricultural, and domestic workers

Requirements
- To be registered and in good standing
- Accredit a minimum contribution period
The amounts used to calculate the economic benefits to which the worker is entitled are called regulatory bases (BR). These originate from the bases for common contingencies (BCCC) and professional contingencies (BCCP), depending on the cause of the contingency.
Healthcare
The pharmaceutical benefit is free for pensioners and those receiving medication for accidents or diseases. It generally includes medicines and medical devices in the proper dosage as and when due.
Temporary Disability
(12 months, then goes to trial and a set maximum could reach 30 months, then Permanent Disability).
For illness or accident involving the suspension of the employment contract. For this reason, the employee is compensated for the income forgone while receiving healthcare. If it is a common disease, the worker must have contributed for a grace period of 180 days within 5 years immediately preceding the event in question.
Permanent Disability
This is the situation where a worker, even after receiving medical treatment, presents anatomical or functional reductions that decrease or negate their ability to work.
- Permanent partial disability for the usual occupation: This causes the employee a reduction of not less than 33% of normal performance for that profession, but without preventing the completion of the fundamental tasks of the same.
- Permanent total incapacity for the usual occupation: This disables a worker from performing all tasks of a particular profession, but they can engage in another.
- Permanent total incapacity for any work: This involves disqualification for any profession.
- Severe disability: This is the situation where, in addition to being incapacitated, the employee needs the assistance of another person to perform the most basic acts of life.
Motherhood and Similar Situations
Benefits at 100% of BR are provided in cases where labor absenteeism occurs because of maternity, adoption, or foster care by the employee.

Contribution requirements:
- <21 years: No contribution required.
- 21-26: 90 days of contributions in the past 7 years or 180 days over their working lives.
- >26: 180 days of contributions in the past 7 years or 360 days of contributions throughout their working lives.
Unemployment Benefit
This applies to those who still want and can work but have lost their jobs or seen their hours of work reduced by at least one-third.
- Involuntary unemployment: Originates at the end of a fixed-term contract, dismissal, or termination of the contract by the worker for just cause (usually those who are entitled to receive compensation).
- Voluntary unemployment: Caused by neglect and voluntary redundancy. In these cases, no economic benefit can be obtained.
This service must be requested 15 days after the dismissal. Payment begins after six months, with the amount being 70% of the BR for the first 6 months and 60% for the remaining months. The maximum duration is up to 6 years, and the recipient must have contributed for at least 2 years to receive the benefit.
Protection in Case of Unemployment Assistance
There are two levels of protection in case of unemployment within an employer:
- Unemployment allowance: Requires one month of inscription, no rejection of a suitable job offer, no refusal to participate in training, promotion, or retraining, and an annual income not exceeding 75% of SMI (without extra payments) during the period of the grant. Its duration is variable and may reach up to 30 months. The amount is 80% of IPREM.
- Active insertion income: Intended to encourage the return to the labor market of people with integration difficulties and financial need. The maximum duration is 11 months, and the amount is 80% of IPREM.
Retirement
The eligibility requirements for a retirement pension are:
- Having reached 65 years of age (age can be lowered or anticipated in some cases)
- Having contributed for at least 15 years, of which at least 2 must have been in the 15 years preceding the date of retirement
- Being registered and signed (with exceptions)
Partial Retirement
- From age 60, or 61 if it is mutual before 1967.
- From 61 without mutual status.
- From 60 with mutual status.
Early Retirement
- In groups with painful, toxic, or unhealthy activities, such as mining, bullfighting, or aerial work flight personnel.
- Workers with a degree of disability equal to or greater than 45%.
Calculation of the provision is in accordance with the following schedule, with the maximum allowed being 100% of BR, achieved with 35 years of contributions.

Death and Survival
The beneficiaries of the provision for death and survival are the spouse (if not remarried), orphans (under age 18 and older in the cases provided by law), and second-degree relatives who can prove their economic dependence on the deceased.
