Temporary Presidential Vacancy and Succession

Legal Basis: Article 234 of the CRBV.

A temporary presidential vacancy shall be supplied by the Chief Executive for up to ninety (90) days, extendable by a decision of the National Assembly for an additional ninety (90) days. If a temporary absence continues for more than ninety (90) consecutive days, the National Assembly shall decide by a majority of its members whether an absolute vacancy should be declared.

Powers of the President

Legal Basis: Article 236 of the CRBV.

  • Comply with and enforce the Constitution and the law.
  • Direct government action.
  • Manage the national treasury.
  • Grant pardons.
  • Call a referendum as provided in this Constitution.

Powers of the Vice President

Legal Basis: Article 238 of the CRBV.

  • Collaborate with the President of the Republic on government actions.
  • Coordinate relations between the National Executive and the National Assembly.
  • Chair the Federal Council of Government.
  • Replace the President of the Republic during temporary absence.
  • Propose to the President of the Republic the appointment and removal of ministers.

Removal of the Executive Vice President

Legal Basis: Article 240, first paragraph, of the CRBV.

The approval of a motion of censure against the Executive Vice President, by a vote of not less than three-fifths (3/5) of the members of the National Assembly, entails their removal. The removed officer shall not be eligible for the post of Chief Executive, Senior Vice President, or Minister for the remainder of the presidential term.

Composition of the Council of State

Legal Basis: Article 252 of the CRBV.

The Council of State is chaired by the Chief Executive and also comprises five (5) persons appointed by the President of the Republic, a representative designated by the National Assembly, a representative designated by the Supreme Court of Justice, and a Governor appointed by the Council of Chief Executives of the State concerned.

Government and Administration in Each State

Legal Basis: Article 160, first paragraph, of the CRBV.

The government and administration of each State corresponds to a Governor.

Powers of a State

Legal Basis: Article 164 of the CRBV.

  • Promulgate their Constitution to organize public powers, in accordance with the provisions of this Constitution.
  • Organize their Municipalities and other local political and territorial divisions, under this Constitution and the law.
  • Create, organize, collect, control, and manage taxes related to sealed paper and documentary stamps.
  • Establish, govern, and organize state public services.
  • Execute, preserve, manage, and use land routes under State Authority.
  • Exercise all powers not assigned, in accordance with this Constitution, to national or municipal jurisdiction.
