Urban Transport Regulations for Passengers in Cadiz

Article 1: Purpose

The purpose of this regulation is the regulation of urban transport services of passengers within the municipality of Cadiz, with or without a taximeter device approved by Royal Decree of March 16, 1979, No. 763/9.

Article 2: Terms

Class A) Auto taxis with a meter, within the town.

Class B) Self-tourism: no meter counter, inside or outside the village.

Class C) Special or fertilizer: Vehicles operated inside or outside the village, have more power, luxury ability, dedication, purpose.

Section 1: General Rules

Article 3: Vehicle Ownership and Insurance

The vehicle must be shown as the license holder’s property in the Register of the DGT. The owners must agree on the insurance policy, which must cover the risks outlined in existing legislation.

Article 4: Vehicle Replacement

Holders may replace the vehicle with another; simply change the formal communication, which will be subject to approval by the municipality.

Article 5: Vehicle Transfers

Transmissions by inter vivos acts of rental vehicles require a change in formal communication and authorization by the municipality.

Article 6: Vehicle Bodywork and Interior

  • Bodywork must be closed with doors for easy access and operation to facilitate the maneuver smoothly.
  • The minimum size inside the vehicle and seat comfort are those needed to own such vehicles.
  • Doors should be equipped with a mechanism to trigger your glasses at the user’s will.

Article 7: SP Plate Requirements

Vehicles must have an SP plate at the front and one at the back with a white background and black letters. Dimensions are as follows:

  • Thickness of Stroke: 8 mm

Article 8: Vehicle Capacity

The capacity of the vehicle must not exceed 7 seats for classes A and B, including the driver. Exceptions may allow up to 9 seats. Children aged 3 to 10 years will be counted as two children per seat.

Article 9: Vehicle Age Limit

This article does not authorize the commissioning of a car older than 5 years for taxis and auto cars.

Article 10: Vehicle Inspections

No vehicle may enter service without prior review of security, maintenance, and documentation by the Delegations for Industry and Energy and the respective Local Authority, except for new vehicles. Extraordinary revisions checking vehicles for safety, conservation, and documentation are made by the Delegation of Industry and Energy and the City on the same day and time. This inspection is produced in the first quarter. Revisions may be made at any time, without charge, but they can motivate, in case of violation, the appropriate sanction. Article 11: Radio Usage

A radio may be used if the traveler wants.

Article 12: Advertising

With permission from the City Council and with relevant legal requirements, advertisements may be placed inside the car, provided they do not impede visibility and retain aesthetics. Advertising outside the vehicle is subject to the provisions of the highway code.

Article 13: Vehicle Condition

Vehicles must be in good condition regarding presentation, security, and performance requirements for the provision of correct service. Vehicles may be withdrawn from circulation if they do not meet these conditions. Bags and inappropriate upholstery are not permitted.

Section 2: Licenses

Article 14: License Publication and Objection

For the provision of these regulations, it shall be provided to hold the Municipal License. Article 15: License Granting Criteria

The granting of licenses by the city council is determined by the necessity and convenience of the service to the public. The following will be analyzed:

  4. The impact of new licenses granted in the overall transport and traffic.

Article 16: License Applicants

The following may apply for licenses for Auto-Taxi:

  1. Drivers employed by license holders of Class A and B providing full-time service in the profession, accredited by possession and validity of driver licenses issued by the City of Cadiz and the registration and trading on such a concept of social security.
  2. Holders of licenses issued by the City of Cadiz in Class B, provided they are holders of one of the Self-tourism and reverse it when they obtain the Self-taxis.

Licenses may apply Auto-tourism drivers employed in Class B of paragraph a) and natural or legal persons referred to in paragraph c) both of the above. The natural and legal persons may freely apply for Class C License in accordance with the provisions of Article 15 of this regulation.

Article 17: License Application Process

The license will be sought through a request addressed to the Mayor of Cadiz, which will include the following:

  1. Name, surname, address, age, sex, marital status, occupation, and length of residence of the municipality of Cádiz. If the applicant is a legal entity, it must certify that it has its registered office in Cadiz and residence of more than one year.
  2. Make, type or model, power, number of seats of the vehicle with which he has to provide the service as requested license, and the address of the garage in which to save.

Article 18: Ineligible Applicants

The following may not apply for licenses:

  1. Council members during their term or their spouses and direct descendants or collateral.
  2. Officials and municipal employees, either personally or through third parties, or their spouses and lineal descendants.
  3. Heads, officers, enlisted men, and officers of the traffic police.

Article 19: License Award Priority

The award of licenses for Class A Self-taxis follows this order of priority:

  1. Continuity will be interrupted when he voluntarily abandons the profession of drivers employed for a period equal to or exceeding 6 months.
  2. Through open tender, those who adjudicate permits are not under the preceding paragraph.

The priority (preference for a case must be addressed with respect to another) for the allocation of Class B licenses Auto-tourism will be for drivers employed by the license holders of Class B, which referred the paragraph a) of paragraph 1, by strict seniority and not so regulated by open competition before.

Article 20: License Transferability

The license shall not be transferable except in the following cases:

  1. The death of the owner, for his widowed spouse or heirs (women or children).
  2. When the widowed spouse and legitimate heirs to the retiree cannot exploit the license as the sole and exclusive activity and consent of the council. Any other heir in possession of the registration certificate.

Article 21: Class C License Requirements

Article 22: License Classification

Article 23: License Revocation

Article 25: License Leasing Prohibition

Article 26: Lost and Found

The drivers of public service vehicles for urban transport are required to check inside the car every time they become vacant to check for valuables left in them. They must report any lost items to the Municipal Police Headquarters within 24 hours.

Article 27: Class C Vehicle Minimum

The holders of Class C shall not be employed to have 3 vehicles, at least with the relevant licenses.

Article 28: License Operation

Article 29: Service Time Limits

Article 32: Tariff Regime

Article 40: Required Documents

Article 43: Night Service Surcharge

The night service will be 50% between 22:00 and 08:00.

Article 44: Vehicle Maintenance

Each vehicle will stop for a day a week for review, cleaning, and tuning, no service except for special reasons is authorized by the City. In the rear side will be a letter that day to rest.

Article 45: Driver Meal Breaks

Section 5: Self-Cars

Article 46: Vehicle Specifications

Article 57: Municipal Permit Application

Article 58: Driver Information
