Cooperation Needed (143.2)

Type Purpose

In the necessary cooperation required of acts without which suicide would have been impossible, collusion is ruled out. It also includes executive acts for the preparation of suicide without any third party executing the death of the suicide. It is the commission by omission, but only for a willful, reckless occurring in the case of murder under the circumstances.

Type Subjective

Just accept the willful commission. The cooperative will know of the suicide and aims to help him. In the event of bankruptcy law, that provision will apply more punishment in this subsuming the other acts.

Executive Cooperation (143.3)

Type Purpose

Not only is it cooperation, but also runs its own death from suicide, but do not treat it as murder as it remains at all times the suicide bomber who owns the domain of fact. Supports default fee, provided that the “executor” is in a position of guarantor in respect of which they want to die.

Type Subjective

Need of fraud, referring both to the lethal action itself as the knowledge of the serious and determined will of the suicide.

Euthanasia (143.4)

The victim must suffer a serious disease that will inevitably lead to death or suffering permanent and hard to bear. It also requires a willingness to express and unambiguous desire to die. It involves an attenuated type of paragraphs 2 and 3.

The acts of cooperation must be necessary and direct actions, i.e., active euthanasia (directly to anything that tends to cut life). There is no provision for criminal purposes and passive (omit a conduct intended to prolong life artificially or unnecessarily). Indirect active euthanasia. Substances are supplied indirectly to alleviate the pains of disease, poisoning the body and inevitably approaching death. It is not punished for not meeting direct means.

Dependent Life

Fertilization – Nesting – Onset of fetal brain activity

The majority accepted that the second nesting is for the purpose of computing the beginning of human life dependent, and the total separation of the womb as a terminator of it.

Abortion (Art. 144-146)

Can be defined as fetal death caused willfully within the mother, either by causing premature expulsion of a non-viable fetus outside the womb. Therefore, the life of the fetus is legally protected, but also taking into account the life, health, freedom, or dignity of the pregnant woman.

Type Purpose

Action to end the life of the fetus with a multitude of ways, resulting in the effective death of the fetus. It is therefore a result of a crime of material which is accepted by the attempt. The perpetrator can be anyone from a third party, with or without mother’s consent, to an abortion that causes or permits illegally pregnant. However, where the illegality arises from the violation of the procedural requirements set, the woman is exempted from punishment.

Type Subjective

The abortion performed by a third party outside of the cases permitted by law is punishable as if intentional as a result of negligence. Diverting the case of the woman who performs her own abortion or consents to an illegal one can only be done in a willful manner; she shall be exempt in case of an abortion caused by negligence.

Modalities

Article 144. Intentional abortion committed by third parties without the consent of the woman. Prison 4 to 8 years and disqualification from 3 to 10 years to practice any health profession or provide services of all kinds in clinics, gynecological, or public or private.

The Common Requirements Covered by the Law 2/2010 for the Voluntary Interruption of Pregnancy are:

  1. Practice by a doctor or under supervision
  2. That takes place in an accredited health center, public or private
  3. Express written consent of the pregnant woman or legal representative, or in the cases specified by law.
  4. For children under 16 and 17 years, the general legal framework for older women will apply.

Section 145.1 Abortion by a third party with the mother’s consent, except in cases provided by law. It is accompanied by imprisonment for 1 to 3 years and disqualification. Law 2/2010 establishes the legal requirements for the legal practice of abortion:

  • A woman’s request within the first 14 weeks of gestation. Requires prior information about the aid that may be perceived, with 3 days of separation between information and intervention.
  • For medical reasons:
    1. When not exceeding 22 weeks of gestation and whenever there is a risk to the life or health of the pregnant woman.
