Types of Pensions

A. Disability Pension

Non-contributory disability pensions cover permanent physical or mental impairments, whether congenital or acquired. Applicants must:

  • Be between 18 and 65 years old.
  • Have legally resided in Spain for five years, with two immediately preceding the application.
  • Have a disability or chronic illness with a severity rating of 65% or higher.
  • Have no income or insufficient income.

The annual amount is determined by the State Budget Law.

B. Retirement Pension

This is the most significant pension type. Contributory retirement pensions are granted when workers reach retirement age (generally 65) and cease working. Requirements include a minimum contribution period of 15 years, with two within the 15 years preceding retirement. Those not meeting the full contribution period may receive a reduced pension if they meet age requirements. Early retirement is possible under specific circumstances:

  • Employees aged 60 who contributed to the Mutual Industrial before January 1, 1967 (pension amount will be reduced).
  • Workers in exceptionally arduous, toxic, dangerous, or unhealthy jobs.
  • Workers with a disability rating above 65%.
  • Workers aged 61, registered as job seekers, with 30 years of contributions and involuntary unemployment (pension amount will be reduced).

Partial retirement allows combining a part-time job with a reduced pension, proportional to the reduced working hours.

Pension amounts vary based on contribution years:

  • 15 years: 50% of the base amount
  • Gradually increases to 100% with 35 or more years of contributions

C. Widow’s Pension

Eligibility criteria include:

  • Surviving spouse whose partner was actively employed or similar and had completed a minimum of 500 working days.
  • Surviving spouse whose partner was not actively employed but had a 15-year contribution period.

Separated or divorced spouses who have not remarried or entered a new partnership are also eligible. Under certain conditions, a pension may be granted to a domestic partner in a relationship akin to marriage.

The pension amount is generally 52% of the base amount, increasing to 70% if the pensioner:

  • Has dependents (children under 26 or incapacitated adults living with them).
  • Relies on the pension as their primary income source.
  • Has an income below the threshold for minimum allowances.

This pension, unlike disability and retirement pensions, is compatible with employment income.

D. Orphan’s Pension

Children of the deceased are generally eligible, provided they meet the same requirements as for the widow’s pension. Children must be under 18 or unable to work. The age limit extends to 22 if unemployed with income below the minimum wage, and to 24 in cases of absolute orphanage.

The pension amount is 20% of the base used for the widow’s pension, rising to 52% for absolute orphans. The combined total of widow’s and orphan’s pensions cannot exceed 100% of the base. This pension is also compatible with employment income.

Non-Contributory Pensions

Requirements for Non-Contributory Retirement Pension

  • Be at least 65 years old.
  • Have legally resided in Spain for the ten years preceding the pension, including the two years immediately before application.
  • Lack sufficient income.

The amount is the same as the annual non-contributory disability pension.
