Functions and Regulatory Scope of the National Land Transport Institute
Article 23: Duties of the National Institute of Land Transportation
The National Institute of Land Transportation is responsible for the following duties:
- Planning and implementation of institutional strengthening programs for the land transport sector.
- Maintaining the National Land Transport Register.
- Registration, issuance, renewal, and monitoring of motor vehicle driving licenses at the national level, across all grade levels and categories.
- Registration, issuance, and control of professional qualifications required to drive motor vehicles for profit (commercial use).
- Granting, registration, and control of motor vehicle license plates intended for public or private use, according to different classifications and procedures.
- Issuing permits and registration for public and private land transport services, as well as the regulation and control of public land transport of passengers and cargo within the area of national competence.
- Project surveys, permitting, regulation, and registration of national related services, including:
- Public and private terminals (passenger, tourist, freight, and intermodal transfer).
- Hostels and temporary road passenger facilities.
- Cargo transport, parcel delivery (encomienda), and school transport.
- Car dealers (Institute certified).
- Fixed and mobile vehicle technical review stations (mechanical and physical).
- Location and access of service stations, towing services, cranes, and any other platform, in accordance with the law.
- Study and review of rates for public land transport of passengers and cargo (freight), as provided by law.
- Planning, operation, and control of the Institute’s resources and those of its decentralized bodies.
- Management of inland transport statistics and traffic control devices.
- Promoting road safety education and awareness.
- Establishing technical criteria and granting permits for the placement of billboards and other advertising media on national roads and adjacent land, controlling their location and administrative removal procedures, in coordination with State and municipal authorities.
- Establishing technical criteria and granting permits for the placement of advertising on vehicles.
- Ensuring compliance with traffic rules and safety regulations at the national level.
- Establishing coordination mechanisms and approval protocols with police forces empowered to control and monitor traffic and land transport.
- Authorizing the provision of public land transport services for passengers and cargo within the area of national competence.
- Granting permits for work affecting road infrastructure within the area of national competence.
- Applying administrative sanctions, as provided in this Act.
- Ensuring the proper operation of ground transportation services.
- Collecting and managing income derived from services rendered and penalties imposed.
- Issuing general or specific administrative acts on matters within its competence. These acts exhaust administrative remedies, allowing interested parties to proceed directly to the administrative jurisdiction.
- Reporting quarterly to the relevant Ministry of People’s Power qualified in the field of land transport regarding income received and administered.
- Controlling and regulating the placement, care, and maintenance of road signage and track demarcation, including authorization for the placement and signage of speed control mechanisms on national highways.
- Granting project certification for public and private terminals, ensuring compliance with relevant technical standards, and registering the service once an operating license is granted.
- Granting operating licenses to related service operators or operators subject to national competition regulations.
- Control, inspection, and supervision of public and private terminals that constitute the National Terminal System for passengers and public and private land transport.
- Performing any other duties assigned or conferred by this Act.
