Decree Law No. 1,094 of 1975
Sets rules on foreigners in Chile. Published in Journal No. 29,208, July 19, 1975
- SECTION 1: The entry into the country, residence, permanent residence, discharge, readmission, expulsion, and control of foreigners are governed by this decree-law.
- Article 4: Foreign nationals may enter Chile as tourists, residents, officials, and immigrant residents, according to the standards listed in the respective paragraphs of this decree law.
Article 5
For the purposes of this Decree, a visa is permission granted by the competent authority, stamped on a valid passport, and which authorizes the bearer to enter the country and remain there for a determined period.
- SECTION 6: The granting and renewal of authorizations, tourism, and visas to foreigners in Chile will be decided by the Ministry of the Interior, except those relating to the quality of official residence, which is granted by the Ministry of Foreign Affairs.
- DUTIES:
- ARTICLE 11: International shipping companies may not accept passengers bound for Chile that are not in possession of the documentation that will enable them to enter the country, according to the respective quality of income.

- ARTICLE 44: Foreign tourists are considered those entering the country for recreation, sports, health, studies, business management, family, religious, or similar purposes, not for immigration, residence, or the development of income-generating activities.
- Article 45: Tourists must be holding a passport or similar document issued by the country of their nationality and exempted from the requirement to obtain a consular visa.
- Border: Authorized specific points by the President of the Republic, Interior, National Defense, and Direction of Borders and Boundaries. (International Police, Customs, SAG)
- What is seen consular
- Tourists who are nationals of a country with which Chile does not maintain diplomatic relations should be in possession of passports, registered at the Chilean Consulate or its representative, and have a return ticket to their country or another with respect to which they have entry clearance.
June 1984 Article 597 (Regulation of Aliens)
- SECTION 2: All foreigners entering the country must meet the requirements stipulated in this Regulation and, to stay there, must observe its requirements, conditions, and prohibitions.
- Article 4: Who controls the entry of foreigners. Relate Article 7.
- Article 10: Residents, officials, and immigrant residents must enter the country with a visa, meaning, for the purposes of this Regulation, the permit issued by the competent authority stamped on a passport or similar document, valid and which authorizes the bearer to enter the country and remain there for the time specified. The visa will be valid from the date stamped on the passport.
Article 20:
- Passengers on international transport mediums lacking, at entry to the country, appropriate documentation, may be authorized by the border control authorities to remain in the quality of transit passengers.
Article 23
- 5. The tourist card that has been given to passenger ships that must anchor in more than one Chilean port will be withdrawn by the authorities of the last port of call in Chile. The respective shipping company will be responsible for the return to those authorities of such cards.
- 3. Before the arrival of their aircraft to the country, air navigation companies must notify the authorities, at their request, the number of passengers they are carrying to Chile, whether in transit or destination. They must also provide the identification of some of them, indicating the point of shipment, when requested in writing.
- ARTICLE 93: For the purposes of the preceding articles, the following shall be considered as valid identification for the admission of tourists, one that meets, at least, the following requirements:
- 1. Name
- 2. Nationality
- 3. Date of Birth
- 4. Signature and stamp of the authority that issued it, and
- 5. Photography.
- ARTICLE 112: For the purposes of this Regulation, a pass is the document issued by the units under the Chilean Investigative Police, which entitles the holder to leave the country.
- This document must be requested at least 24 hours in advance of discharge and will have a maximum period of five working days. The departure date must be recorded in the text. It can be validated, in which case they will issue a new document. It shall be submitted to the official border control authorities to control their release.
- The pass must contain at least the following information: full name of the person concerned, nationality, Chilean identity card for foreigners, passport number or alien’s identity, place of discharge, country of destination, date and place of issue, stamp, and signature of the responsible official.
