Agents of the Building
Agents of the Building: Natural persons or legal entities involved in the construction process under current law.
Promoter
Promoter: A natural or legal person, public or private, who initiates, promotes, and finances the construction works. Their duties include:
- A) Taking ownership of the land.
- B) Facilitating the documentation and information necessary to draft the project.
- C) Obtaining the building permit and/or other administrative authorizations.
- D) Subscribing to the Certificate of Completion and insurance.
- E) Providing documentation of the work executed.
Designer
Designer: The agent who drafts the project. Their responsibilities are:
- A) Possessing the corresponding qualifications.
- B) Preparing the project in accordance with regulations.
- C) Agreeing on partial collaborations with the developer.
Project Director
Project Director: The individual who leads the project and work under the contract to achieve the proposed end. Their duties include:
- A) Possessing the appropriate academic qualifications.
- B) Checking the foundation and structure on-site.
- C) Resolving potential complications that arise during the work.
- D) Developing changes to the project when necessary.
- E) Developing plans for the final resulting work.
Director of Work Execution
Director of Work Execution: The individual who leads the execution of the work’s materials, construction quality control, and the quality of what is built.
Duties of the Director of Work Execution
- A) Possessing the appropriate academic qualifications.
- B) Verifying the receipt of construction products on-site.
- C) Directing the implementation of the materials.
- D) Recording instructions in the order book and attendance log.
- E) Signing the minutes of replanning or the commencement of work and the final building certificate.
- F) Assisting in the documentation of the work performed.
Optional Management
Optional Management: Depending on the Technical Building Code (CTE), this role is composed of the Project Director and the Director of Work Execution.
Safety and Health Coordinator (Project Phase)
Safety and Health Coordinator (Project Phase): The competent technician appointed by the Promoter to coordinate the implementation of Occupational Risk Prevention during the design phase of the work. Their responsibilities include:
- A) Making constructive decisions and planning the work.
- B) Estimating the time required to complete the work.
Safety and Health Coordinator (Execution Phase)
Safety and Health Coordinator (Execution Phase): The technical lead responsible for Health and Safety tasks in construction, coordinating:
- A) The general principles of Prevention and Safety.
- B) Activities of the work so that all members apply the general principles of Prevention and Safety.
Builder
Builder: The entity that implements the works or parts thereof with human and material resources, subject to the project and the contract. Their duties include:
- A) Executing the work according to the project.
- B) Possessing the qualifications and professional training to be a builder.
- C) Appointing the Head of Work.
- D) Assigning resources and manpower to the work.
- E) Formalizing subcontracting.
- F) Signing the minutes of replanning and acceptance of the work.
- G) Providing documentation to the Project Director.
- H) Subscribing to the provided guarantees.
Head of Work
Head of Work: A person designated by the Builder with technical training. Their responsibilities include:
- A) Representing the Builder, responding in technical, temporary, and economic aspects.
- B) Organizing the execution with their team, including command staff, technical staff, and administrative staff.
Subcontractor
Subcontractor: A natural or legal person who contractually undertakes a commitment with the contractor or another subcontractor to carry out certain parts of the work.
Self-Employed Worker
Self-Employed Worker: A natural person who directly and personally performs a professional activity. When a self-employed worker employs other workers, they will be considered a contractor or subcontractor.
Product Suppliers
Product Suppliers: Manufacturers, wholesalers, importers, or sellers of construction products. Their responsibilities include:
- A) Undertaking the delivery of products according to the order.
- B) Providing instructions for the use and maintenance of the supplied products.
Quality Control Entities and Testing Laboratories
Quality Control Entities and Testing Laboratories: These entities provide technical assistance to verify the quality of the project through testing or evidence according to applicable rules. Their duties include:
- A) Providing technical assistance and delivering results.
- B) Producing evidence of sufficient capacity of human and material resources necessary to adequately perform the work.
