Implementation Process: Tenerife and Madrid

A) If multiple jurisdictions are involved, the court with jurisdiction over the executed portion of the agreement will preside. This could be in Madrid, at the address of the surety, or in Santa Cruz de Tenerife. Before execution, the court will automatically examine its territorial jurisdiction and inform the claimant. The claimant may contest the proposed jurisdiction within five days of receiving notification.

B) The bank must provide the court with the enforcement documents, including the signed commercial contract, the broker’s policy with seat and registration date, and proof of notification to the debtor and guarantor regarding the amount due.

Provisional Execution: Two Farm Owners

A) No, provisional execution typically applies only to verdicts.

B) In a declarative trial, a conviction is provisionally enforceable. Acknowledging the right is sufficient for land registry title registration.

C) The court mandates the debtor to fulfill obligations within a specified timeframe. The claimant can request a third party to execute at the debtor’s expense or claim compensation for damages.

D) The defeated party’s interests are considered, including potential accrual during implementation and associated costs.

F) The judicial determination request should be detailed and may include supporting opinions and documents. A response is expected within 10 days.

Arbitration: Land Transport

A) Binding arbitration aims to exclude court involvement unless parties agree otherwise. Enforcing arbitration coercively can conflict with the right to effective judicial protection.

B) Arbitrators provide effective protection of rights and interests while respecting essential principles of due process and equality. This creates enforceable efficacy similar to court-ordered enforcement.

C) The court could potentially annul the award for infringing on the right to effective judicial protection. Raising a constitutional question under Article 163 EC might be appropriate. If Article 38 of the Arbitration Law contradicts the right to effective judicial protection, the provisions of the Arbitration Law should be supplementary to the provisions of the Organic Law of the Judiciary.

Matrimonial Proceedings: Ernesto and Adoration

A) Adoration can request provisional measures as outlined in Article 103 of the Civil Code. After agreed measures, Adoration has 30 days to file for separation or divorce. The judge will summon Ernesto and the prosecution, seeking an agreement. If unsuccessful, arguments and evidence will be presented, leading to a final, unappealable decision. Ernesto may contest and request spousal support through a separate lawsuit with oral trial procedures.

B) Adoration cannot contest paternity during the marriage unless Ernesto is incapacitated. If divorced, not widowed, she could not contest paternity due to the statute of limitations. If the mother is alive, she could intervene regarding guardianship and custody by claiming paternity.

C) Assuming community property, the library is jointly owned. The judge can order interim measures, such as appointing an administrator or incapacitating Ernesto to prevent further action, assigning the library to Adoration’s care.

D) Adoration can request an interim measure to attach part of Ernesto’s income for mortgage payments.
